Having access to timely dispute resolution services is an important strategy in managing psychological safety in your organisation. To help understand more about what a workplace mediation and facilitated discussion involves, we thought we’d share a few of our FAQ’s.

What is Workplace Mediation?

Workplace Mediation is an alternative dispute resolution process which can facilitate a non-adversarial approach to conflict management for a wide range of issues. Workplace mediation is a structured process where a neutral and independent third person facilitates communication between two people in dispute to identify and explore issues. The discussion is managed by a trained and impartial mediator and supports the parties to develop options, their own solutions and reach a consensual agreement. This process can be particularly useful in assisting participants in changing the quality of their conflict interaction to a more proactive interaction for future relationships.

What is a Facilitated Discussion?

A facilitated discussion is a less formal, guided conversation aimed at addressing misunderstandings or concerns between individuals or groups in the workplace. Unlike mediation, facilitated discussions focus on creating a supportive space for open communication rather than resolving disputes. The facilitator ensures that all voices are heard, enabling participants to clarify expectations, improve collaboration, and rebuild trust.

What Are the Steps Involved with Mediation and Facilitated Discussion?

Mediation:

  • Initial Contact: The mediator gathers information about the dispute and assesses suitability for mediation.
  • Preparation: Individual meetings occur with each party to understand their perspectives and goals.
  • Joint Session: A structured meeting (usually a full-day in length) where parties share their views, facilitated by the mediator.
  • Negotiation: Exploring options and working towards a mutually acceptable resolution.
  • Agreement: Documenting the outcomes and commitments in a clear and actionable agreement which is signed by all parties. The agreement is kept confidential.

Facilitated Discussion:

  • Preparation: The facilitator identifies key issues and prepares an agenda in consultation with the parties.
  • Setting ground rules: Establishing guidelines for respectful and constructive dialogue.
  • Guided conversation: Encouraging participants to share perspectives and address concerns.
  • Shared problem solving: Identifying solutions or agreements to improve communication and collaboration.
  • Follow-Up: Providing ongoing support to ensure agreed actions are implemented successfully.

When to Refer for Mediation or Facilitated Discussion?

  • Workplace Conflict: When interpersonal disputes or tensions affect productivity or team dynamics.
  • Miscommunication: To address misunderstandings or breakdowns in communication.
  • Team Dynamics Issues: When conflicts arise within teams, impacting collaboration and morale.
  • Performance Concerns: To address issues stemming from differing expectations or perceived unfairness.
  • Return-to-Work Support: To resolve disputes following an extended leave or injury.
  • Proactive Conflict Management: To address emerging issues before they escalate into formal grievances.
  • Formal complaints process: Mediation can be utilised as part of the resolution in a formal complaints process to assist with all of the above.

Who Can Deliver Mediation Services?

Mediation and facilitated discussion services are typically delivered by trained professionals with expertise in conflict resolution and workplace dynamics. These include:

  • Certified Mediators who have completed further training and certification to become a mediator.
  • Workplace Consultants with experts in organisational dynamics and team building.

These professionals work closely with all parties to foster understanding and guide productive conversations, helping to create a more cohesive and harmonious workplace.
